These Terms & Conditions apply to all landscape gardening and associated works carried out by Boots on the Ground South Wales Ltd (“we”, “us”, “our”) for both domestic and commercial clients (“you”, “the Client”).

2. Scope of Services

We provide professional landscape gardening services including, but not limited to:

  • Garden renovations
  • Walling
  • Patios and paving
  • Fencing
  • Decking
  • Artificial and natural turfing
  • Sleepers and timber structures
  • Regular garden maintenance
  • Garden clearance and waste disposal

Only works explicitly stated in the quotation are included.

3. Quotations, Variations & Pricing

  • All quotations are valid for 30 days from the date of issue
  • Prices are fixed based on the agreed scope of works
  • Landscaping works are subject to ground conditions, access, and unforeseen circumstances
  • Where unforeseen issues arise (including hidden obstructions, drainage problems, or unstable ground), additional costs may apply and will be discussed where possible
  • Any variation or change to the agreed scope of works must be confirmed in writing and may result in additional costs and/or revised timescales
  • No additional works will be carried out without written agreement

4. VAT

  • All works are subject to VAT at 20%, unless stated otherwise
  • VAT will be clearly shown on all quotations and invoices

5. Payment Terms

  • A non-refundable deposit of 10% of the total project cost is required to secure a booking
  • The project is considered booked once the deposit has been received
  • 60% of the remaining balance, referred to as a mobilisation payment, is payable no later than 14 days prior to the project start date to allow for the purchase of materials and associated services
  • 30% of the remaining balance is payable upon completion of the works, once the Client has inspected and signed off the project
  • On larger projects, Boots on the Ground South Wales Ltd reserves the right to amend the payment schedule to include further staged payments, which will be clearly outlined at the quotation stage

6. Right to Suspend Works for Non-Payment

  • Boots on the Ground South Wales Ltd reserves the right to immediately suspend works where any payment is overdue
  • Suspension of works due to non-payment shall not constitute a breach of contract and may result in delays and additional costs, which shall be chargeable to the Client

7. Waste Removal

  • Waste removal is included only where specified in the quotation
  • Waste remains the responsibility of the Client until removed as part of the agreed quotation
  • Additional or unexpected waste may incur extra charges

8. Access, Underground Services & Authority

  • The Client must provide safe, clear, and suitable access to the work area, including parking where required
  • The Client is responsible for identifying and disclosing the location of underground services including cables, pipes, drainage systems, and irrigation
  • The Client confirms they have the authority to instruct works on the property
  • Boots on the Ground South Wales Ltd shall not be liable for boundary disputes, neighbour objections, or third-party claims arising from the works
  • We accept no liability for damage to undisclosed services or hidden obstructions

9. Health & Safety

  • Boots on the Ground South Wales Ltd reserves the right to immediately suspend or stop works where site conditions are unsafe, hazardous, non-compliant, or unsuitable, or where the actions or omissions of the Client or third parties compromise health and safety
  • The Client is responsible for ensuring the site is safe, accessible, and compliant with all relevant health and safety legislation
  • We reserve the right to refuse to commence or continue works where conditions may place persons at risk or invalidate insurance
  • Any delays, suspension, or additional costs arising from unsafe conditions, restricted access, or Client actions shall be fully chargeable
  • Persistent or unresolved health and safety issues shall constitute grounds for termination

10. Weather Conditions & Delays

  • Landscaping works are inherently weather dependent
  • We reserve the right to postpone or suspend works where weather, ground conditions, or official warnings make it unsafe or impractical to proceed
  • Weather-related delays do not constitute a breach of contract and do not entitle the Client to cancel or claim compensation
  • All start and completion dates are estimates only

11.  Force Majeure

  • Boots on the Ground South Wales Ltd shall not be liable for delays or failure to perform due to events beyond our reasonable control
  • Such events include, but are not limited to, extreme weather, flooding, fire, illness or injury, unforeseen family emergencies (including illness of children or dependants), supply chain disruption, fuel shortages, utility failures, acts of God, or government restrictions
  • Where such events occur, timelines shall be extended and no refunds or compensation shall be payable

12. Rescheduling

  • Requests to reschedule works must be discussed as soon as possible
  • Rescheduling is subject to availability and at our discretion
  • Where rescheduling is requested after the deposit and/or mobilisation payment has been paid, all payments remain strictly non-refundable
  • Additional costs resulting from rescheduling may be charged

13. Cancellation

  • As much notice as possible is required for cancellations
  • All payments made are strictly non-refundable once a mobilisation payment has been paid
  • No refunds will be issued under any circumstances where materials, labour, or services have been ordered or allocated

14. Termination

  • Boots on the Ground South Wales Ltd may terminate the contract immediately where the Client fails to make payment, breaches these Terms & Conditions, restricts access, interferes with the works, creates unsafe conditions, acts unreasonably, or requests unapproved changes
  • All payments remain non-refundable upon termination
  • The Client remains liable for all costs incurred up to termination
  • We reserve the right to remove unpaid materials or equipment

15. Materials Ownership

  • All materials supplied remain the property of Boots on the Ground South Wales Ltd until paid for in full, including VAT
  • Unpaid materials may be removed from site

16. Existing Surfaces & Reasonable Tolerances

  • Landscaping works may cause unavoidable disturbance to surrounding areas. Reinstatement is included only where stated
  • Minor variations in levels, alignment, or finishes are inherent and do not constitute defective workmanship

17. Natural & Living Materials

  • Natural and man-made materials may change over time
  • Turf, plants, trees, and shrubs are living materials, and their performance cannot be guaranteed once installed

18. Aftercare Responsibility

  • Responsibility for aftercare, watering, and maintenance transfers to the Client upon completion
  • Damage caused by lack of aftercare, misuse, pets, third parties, or weather is not covered

19. Client Use of Work Areas

  • Any advice not to access or use certain areas during or after works must be strictly followed
  • The Client is responsible for ensuring compliance by all occupants, visitors, contractors, and pets
  • Damage caused by premature use or interference is not our responsibility and remedial works will be chargeable

20. Warranty & Defects

  • Any workmanship issues must be raised immediately upon completion
  • Genuine defects caused by faulty workmanship will be rectified within a reasonable timeframe
  • This does not cover wear and tear, natural movement, weather effects, or misuse.

21. Client Indemnity

  • The Client shall indemnify Boots on the Ground South Wales Ltd against all claims, losses, or damages arising from unsafe conditions, undisclosed services, third-party interference, or breach of these Terms & Conditions 

22. Limitation of Liability & Consequential Loss

  • To the fullest extent permitted by law, Boots on the Ground South Wales Ltd shall not be liable for any indirect or consequential losses, including loss of income, business, rent, use, or enjoyment
  • Our total liability is strictly limited to the value of the works carried out 

23. Photography & Marketing

  • Boots on the Ground South Wales Ltd may photograph or record works before, during, and after completion for marketing purposes
  • No identifiable individuals or personal data will be used without consent
  • By accepting these Terms, the Client grants a royalty-free, perpetual right to use such images
  • Privacy concerns must be raised in writing prior to works commencing

24. Entire Agreement

  • By payment of the deposit, the Client irrevocably agrees to and accepts these Terms & Conditions in full

25. Governing Law

These Terms & Conditions are governed by the laws of England and Wales
